Jurors Award $500k+ in Settlement for Man Mocked During Surgery

One Virginia man filed a lawsuit for defamation and medical malpractice, naming the defendants the surgeon, anesthesiologist, and gastroenterologist. The jury awarded him $500,000, as well as $200,000 in punitive damages.

Exploring the Details of the Incident

The man underwent a colonoscopy in April 2013 and captured all of the comments made when he left his cell phone on record. The anesthesiologist reportedly called the man a “retard” and implied that the man had syphilis. She stated the following: “It’s probably tuberculosis in the penis, so you’ll be all right.”

The anesthesiologist also stated: “After five minutes of talking to you in pre-op, I wanted to punch you in the face and man you up a little bit.”

Moments before the colonoscopy began, the man pressed “Record” on his cell phone, and that was when the harsh comments were captured.

After the operation, all three practitioners forged a fake diagnosis and forced one of the assistants on staff to lie to the patient. The doctors also were alleged to have falsified medical records to come up with the false diagnosis. During the trial, one of the doctors was dismissed from the trial after the first day. The Virginia Board of Medicine has yet to consider what steps to take against the doctors, but apparently, the anesthesiologist is no longer working at the Bethesda, Maryland facility, Aisthesis.
